EXAMINATION OF SOME COURT DECİSİONS WITHIN THE FRAMEWORK OF THE NEWS’ LEGAL ELEMENTS

Freedom of expression is one of the basic human rights in contemporary democracies. The European Convention On Human Rights and The Universal Declaration Of Human Rights emphasize that freedom of expression is one of the basic human rights. In order for the freedom of expression to be used in a healthy way, it is necessary for individuals to be allowed to collect, explain and disseminate information. From this perspective the most important tools in the use of freedom of expression are mass media. The most important function of these tools which have many functions is the notification function. While preparing the news, certain rules must be followed in order to fulfill some legal responsibilities with a free but responsible understanding. In short, it is necessary to make the news in accordance with the legality elements of the news, which are known as the elements of the news. There are various judicial processes regarding the news. In order for media members not to face any criminal sanctions in such judicial processes, the news they make must comply with the law. The basic condition for a news to be in compliance with the law is that the content of the news includes the elements of compliance with the law. This article deals with the legal elements of the news and some court decisions related to these elements.
